FDA Bursts Bubble on Diet Coke Plus Nutrient Content Claim

After reviewing the label for Diet Coke Plus, FDA’s Center for Food Safety and Applied Nutrition issued a warning letter to The Coca-Cola Company for violation of FD&C Act 403(r)(1)(A), which addresses nutrition levels and health-related claims. "The product makes a nutrient content claim but does not meet the criteria to make the claim," the letter states.

 The letter further notes that, because the product is a carbonated beverage, FDA does not consider it appropriate for fortification under 21 CFR 104.20(a), the so-called Jelly Bean Rule.
