BioCell Sues Cyvex for Patent Infringement

ANAHEIM, Calif.BioCellTechnology filed suit against Cyvex Nutrition Inc. for alleged patentinfringement. According to the suit, Cyvex has offered for sale a chickencollagen Type II material that infringes on BioCells BioCell Collagen II®ingredient; BioCell alleges the infringement has occurred willfully and indisregard of BioCells three U.S. patents. The lawsuit further alleges Cyvexhas interfered with BioCells contractural relations and prospective salesthrough false advertising, product misrepresentations and patent infringement.BioCell is seeking an injunction, damages and fees.

At press time, Cyvex had not yet issued a response following INSIDERsrequest for comment regarding the lawsuit.
