Nutratech Files Patent Infringement Suit Against Amax NutraSource

PORTLAND, Ore.Nutratech Inc.filed a lawsuit in U.S. District Court for the District of Oregon in lateFebruary alleging patent infringement by Eugene, Ore.-based Amax NutraSource. Atissue is Amaxs sale of Citrus aurantium (bitter orange); Nutratechsupplies patented Advantra Z material.

The lawsuit claims Amax has infringed on several U.S. patentscovering the use of bitter orange for thermogenesis, weight loss, athleticperformance and appetite suppression. The patents are owned by Zhishin LLC andexclusively licensed to Nutratech. Since patents are only as good as thepatent holders or exclusive licensees willingness to devote resources todefend and protect them, Nutratech has decided to rigorously pursue supplierswho are infringing these patents in order to protect our significant researchinvestment in Advantra Z and our customers competitive advantage in themarketplace, said Bob Green, one of the principals of Nutratech (www.nutratechinc.com).Most recently, Nutratech announced settlement of a patentinfringement suit it brought against Nutrabiotics Research Labs.

Larry Martinez, president of Amax NutraSource (www.amaxnutrasource.com),planned to release a detailed statement afterthoroughly reviewing the complaint. However, he told INSIDER, We areconfident that the allegations made by Nutratech in its complaint are not wellfounded. ... Amax NutraSource suspects this suit is a public relations effort byNutratech.
