Patent Office Confirms Lonza Patent

FAIRLAWN, N.J.Lonza Inc. announced the U.S. Patent and Trademark Office (PTO)confirmed the validity of Lonzas patent No. 5,073,376, which covers oraldosage forms of L-carnitine L-tartrate in tablet, capsule and powdered forms.Another carnitine supplier, Carnitech Inc., had filed a request with the PTO toreview whether the patent was valid.

In May 2003, Carnitech settled in a patent infringement filed by Lonzaconcerning the same patent. In the settlement, Carnitech admitted the validityof the patent and agreed to refrain from future infringement. PTOs decisionensures Lonzas patent will be enforceable through 2010, when it is due toexpire.
