Sabinsa Files 4 Intellectual Property Infringement

Sabinsa filed four lawsuits in the U.S. court for the District of New Jersey against dietary supplement ingredient companies for allegedly selling products that infringe upon its Curcumin C3 Complex patent.

EAST WINDSOR, N.J.—Sabinsa filed four lawsuits in the U.S. court for the District of New Jersey against dietary supplement ingredient companies for allegedly selling products that infringe upon its Curcumin C3 Complex patent.

The patent, No. 5,861,415 titled “Bioprotectant Composition, Method of Use and Extraction Process of Curcuminoids," covers composition, methods of use and methods of extraction of a nutritional supplement in the United States.

The four companies are Olive Lifesciences Pvt. Ltd of Bangalore, India; its U.S. distributor NutriBioLink LLC of Brooklyn, New York; Prakruti Products Pvt. Ltd. of Karnataka, India; and its U.S. distributor HerbaKraft of Edison, New Jersey.

Sabinsa’s patent doesn’t stop other companies from creating and selling other curcumin products, but they cannot use Sabinsa’s composition ratio, market it for antioxidant use, or use Sabinsa’s ethyl acetate extraction method, which is outlined in Sabinsa’s patent.

In an email, Nico Bonne, a spokesman for NutriBioLink, said that the company is not a distributor, but an agent of Olive Lifesciences. He wrote that the company was surprised by the lawsuit and were looking into the matter carefully.

Olive Lifesciences, Prakruti Products and HerbKraft did not provide comment by the time of publication.
