Tishcon Files Second Suit Against Twinlab

WESTBURY, N.Y.--Tishcon Corp., based here, has filed a second suit against Twin Laboratories (Twinlab). According to Tishcon, Twinlab infringed on a patented delivery method that has been exclusively licensed to Tishcon. The company is seeking an injunction for patent infringement by Twinlab's Twinsorb Coenzyme Q-10 (CoQ10) soft gelatin capsules.
This suit follows on the heels of a separate suit filed earlier this month against Twinlab by Tishcon, which cited unfair competition and false information in regard to patents. According to Tishcon, it is the exclusive licensee of U.S. Patent No. 6,056,971, an application from Biosystes USA Inc. for a delivery method that helps dissolve relatively insoluble dietary supplements. This patent specifically covers the bioavailability and manufacturing of CoQ10 soft gelatin capsules.
"These two lawsuits came out at separate times because we didn't want people to be confused about the two separate issues at hand," said Henry Kriegel of the Kriegel Marketing Group, Tishcon's Salisbury, Md.-based PR firm. "It's a lot to swallow at one time."
This action has been filed in the U.S. District Court for the Eastern District of New York. A Twinlab spokesperson said the company had no comment.
