ZonePerfect Nutrition Files Suit Against Hershey Foods

BOSTONZonePerfect Nutrition Co. (www.zoneperfect.com), a subsidiary of Abbott Laboratories(www.abbott.com) andthe makers of ZonePerfect nutrition bars, filed suit against Hershey FoodsCorp. and diet-book author Dr. Barry Sears, to prevent them from marketingproducts that infringe on ZonePerfects trademarks. According to ZonePerfect,the suit, among other things, charges that Hersheys forthcoming SmartZonenutrition bar features a logo nearly identical to the one on ZonePerfectproducts.

Sears created the Zone diet and founded ZonePerfect NutritionCo. but sold his stake about five years ago; Abbott acquiredZonePerfect Nutrition last August.
