BioCell Files Trademark Infringement Suit

SANTA ANA, Calif.—BioCell Technology LLC filed a lawsuit in U.S. District Court, Central District of California, against ProTec Laboratory Inc., alleging trademark infringement. In its Aug. 20, 2008, filing, Newport Beach, Calif.-based BioCell claimed ProTec has infringed, and continues to infringe, on BioCell’s trademark BioCell Collagen II® by offering to sell, selling, distributing and/or advertising dietary supplements that purport to contain that trademarked ingredient but, in fact, do not. BioCell further alleges state and federal unfair competition claims and seeks a permanent injunction, treble damages and disgorgement of profits, among other relief.

ProTec Labs has not responded to INSIDER’s requests for comment on the lawsuit or allegations.
