Decas, Bio-Nutra Settle Lawsuit

CARVER, Mass.Decas Botanical Synergies (DBS) and its parent company, Decas Cranberry Products Inc., settled a patent lawsuit filed by Bio-Nutra Technologies Inc., which claimed DBSs PACran product infringed a Bio-Nutra patent covering cranberry-based dietary supplements; Bio-Nutra supplies CranMAX® cranberry ingredients. Following pre-trial investigations into the method of manufacture and ingredient formulations, Bio-Nutra agreed to dismiss the claims against DBS and not bring similar actions against the company in the future. DBS (www.DecasBotanical.com) stated the resolution resulted in no restrictions, limitations or conditions on the sale or distribution of PACran, which is produced using a proprietary process to contain no less than 1.5 percent proanthocyanidins.
