TMR, MRI Continue Court Battles

OGDEN, Utah—In early June, the U.S. District Court for the District of Utah ruled on a motion for partial summary judgment, filed by Mineral Resources International (MRI) in January 2007 in response to a trademark infringement lawsuit filed against MRI by Trace Minerals Research (TMR) in July 2006. The court granted partial summary judgment in favor of TMR, finding MRI violated a license agreement regarding the use of the TMR trademark ConcenTrace® in the U.S. market and on its Web site. However, the court denied summary judgment on TMR’s quest for injunctive relief to enjoin the use of the ConcenTrace name in international markets, as well as on TMR’s claim that MRI exceeded the scope of its use of such trademarks.
