Coke, Pepsi Settle Fruit Juice Packaging Suit

ATLANTAA U.S. district judge has dismissed a trademark infringement lawsuit after the Coca-Cola Co. and PepsiCo submitted a join motion to terminate the legal action. Terms of the settlement were not disclosed.

As reported by Beverage Daily, Coca-Cola filed the lawsuit in October 2010 alleged the packaging for PepsiCos Trop50 juice was too similar to Cokes Simply juice products and would "likely deceive consumers and dilute the quality" of its own Simply brand of juices.

At issue was the design of the bottle. The Simply juice line was introduced in 2001 and features a carafe-style bottle with an oversized green cap. PepsiCos Trop50 juice debuted in 2009; its packaging was redesigned in August 2010 and features a carafe-style bottle with a large green cap.
