EXETER, Calif.—The International Trade Commission (ITC) has determined that Guangdong Food Industry Institute (GDFII/L&P Food), a Chinese manufacturer of sucralose, does not infringe any of the patents asserted by Tate & Lyle’s Section 337 complaint (docket# 337-TA-604). The complaint alleges infringement of process patents relating to the production of sucralose and certain intermediate compounds. This initial determination was presented by ITC September 22, 2008.

Mr. Wang Sanyong, a corporate officer of GDFII/L&P Food, said: “This positive decision has reaffirmed the strength and innovation of our capability and technological processes, and the integrity of our company.”

GDFII/L&P, headquartered in Guangdong Province, China, in an alliance with Ingredient Specialties, Inc., Exeter, Calif., provides a global distribution network that markets Züeit™ brand sucralose to the food, beverage, nutraceutical and pharmaceutical industries as a high intensity, non-caloric sweetener.

"This has been a long process, but this historic determination is a great milestone for us as we move in the right direction to being vindicated in this complaint and to proceed in our global strategic plans for our Züeit branded high intensity sucralose sweetener," commented Roger Matkin, Chief Executive Officer of Ingredient Specialties, Inc.
