Company Clears Sucralose Patent Infringement

EXETER, Calif.—The International Trade Commission (ITC) has determined that Guangdong Food Industry Institute (GDFII/L&P Food), a Chinese manufacturer of sucralose, does not infringe any of the patents asserted by Tate & Lyle’s Section 337 complaint (docket# 337-TA-604). The complaint alleges infringement of process patents relating to the production of sucralose and certain intermediate compounds. This initial determination was presented by ITC September 22, 2008.

GDFII/L&P, headquartered in Guangdong Province, China, in an alliance with Ingredient Specialties, Inc., Exeter, Calif., provides a global distribution network that markets Züeit™ brand sucralose to the food, beverage, nutraceutical and pharmaceutical industries as a high intensity, non-caloric sweetener.
