Ayush Herbs Wins Trademark Lawsuit

REDMOND, Wash.The Trademark Trial and Appeal Board (TTAB) entered a judgment in favor of Ayush Herbs by denying Hindustan Unilevers application to register a similar AYUSH" trademark. The judgment was entered on March 11.

Ayush Herbs filed its opposition against Unilever in 2006, when the company first attempted to register the AYUSH" trademark. Unilever then filed multiple counter-claims against Ayush which were also dismissed with prejudice by the TTABs judgment.

This was truly a David vs. Goliath story and a gratifying victory for Ayush Herbs," said Ayushs attorney Ryan Kaiser of Chicago-based legal firm Amin Talati LLC.   Unilever used its considerable resources over four and a half years to essentially try to intimidate Ayush Herbs into allowing it to use a similar trademark," he said.
